Andrés Jana is a founding partner of Jana & Gil Dispute Resolution.

He is a lawyer, arbitrator and international expert in the resolution of commercial, investment and public international law disputes before the International Court of Justice (ICJ), the International Centre for Settlement of Investment Disputes (ICSID), and under the international arbitration rules of ICC, UNCITRAL, LCIA, AAA and SCC, among others. He has also acted in local courts in different jurisdictions, such as Chile, the United Kingdom, the Netherlands, the United States and Argentina.

Andrés is Vice President of the International Court of Arbitration at the International Chamber of Commerce (2021-2024) and Chair of Working Group II on Dispute Settlement at the United Nations Commission on International Trade Law (UNCITRAL).

He is a member of the ICSID panel of arbitrators, member of the London Court of International Arbitration, member of the SIAC Council, member of the ICC Latin American Arbitration Group and founding member and vice-president of the Latin American Arbitration Association (ALARB). Andrés has been a professor of private law at the Universidad de Chile since 1997.

Representative Cases

  • Representation of foreign investors, a Chilean/Swiss consortium, in an international investment arbitration under ICSID rules against the Bolivarian Republic of Venezuela. The dispute arose from the early termination of a 20-year concession contract for the international airport of Margarita Island, Venezuela.
  • Representation of a minority shareholder of SMU against another shareholder in a second ad hoc arbitration, for the exercise of an option right contained in the shareholders' agreement.
  • Representation of an autonomous public agency of the State of Panama against its contractor for the construction of the Panama Canal expansion in two ICC arbitrations.
  • Advised in a construction arbitration dispute before the CAM Santiago of a foreign construction company for breach of a contract for the deconstruction of a thermoelectric power plant.
  • Representation of a company owning technical inspection plants against its lessee in a CAM arbitration, for breach of lease agreements and exercise of a penalty clause.
  • Representation of the State of Chile as respondent in an international investment arbitration under ICSID rules initiated against it by the Spanish fishing company Eduardo Vieira S.A., which was a partner in the Chilean company Concar, related to fishing rights in Chilean waters and the relevance of the Bilateral Investment Treaty (BIT) between Chile and Spain.
  • Advising the MOP in a potential dispute related to the construction of a suspension bridge between Pargua and the island of Chiloé, crossing the Chacao Channel.
  • Successful representation of a French electrical company against a Russian company in an arbitration under the SCC rules, for the improper collection of guarantees in the framework of a joint venture entered into between the parties.
